The sales conditions herein are concluded :

And any individual or body corporate who wants to make a purchase on the “Atelier Dentelles website hereinafter called the “buyer”.
Purpose
The purpose of the sales conditions herein is to define the contractual relations between the “Atelier Dentelles” website of J. BRACQ SAS and the buyer as well as the conditions applicable to any purchase made on the Atelier Dentelles commercial website, whether the buyer is a professional or a consumer.
Herein conditions govern the sales, through J. BRACQ SAS, of the products “Dentelles de Calais-Caudry” and “Dentelles de Lyon” sold by meter, as well as all fashion accessories directly connected with lace product (fan, bag, stole, costume jewelry,…of a non-exhaustive list).
Purchase of goods on the present site implies acceptance without reservation of the sales conditions herein by the buyer.
These sales conditions override all other general or special conditions not expressly agreed to by J. BRACQ SAS.
J. BRACQ SAS reserves the right to modify these sales conditions at any time. Under these circumstances, the conditions applicable shall be those in effect on the date of the buyer’s order.
Product features
The products offered are those found in the catalog published on the “Atelierdentelles.com” website and are valid subject to the available stocks.
Each product is accompanied by a brief description by Atelier Dentelles so that its features can be better understood.
The photographs illustrating the catalog products do not enter the contractual framework. They are as true and correct as possible but cannot provide a perfect likeness of the product for sale, particularly as to colors. If errors are introduced, JEAN BRACQ SAS is not liable under any circumstances.
Prices
The prices found in the catalog are expressed in euros (tax and transport costs not included).
The price indicated in the order confirmation is the final price, with all taxes included as well as the VAT applicable on the day of the order for shipments in France and, if applicable, the countries of the European Union according to the rules in effect. The regulation is set by the EEC.
Any rate change shall be added to the price of the products.
The sale of the products presented on the website is reserved to buyers living in France, in French overseas territories or in Monaco and for a delivery required on these geographical areas.
In the event of an order to ship to another country other than Metropolitan France, the customer is the importer of the concerned product or products. The customs duties or other local taxes or import duties or taxes of the Government are susceptible to be demanded. These duties and taxes that may be payable, do not come within the responsibility of J. BRACQ SAS. These costs will be at your charge and are entirely under your own responsibility, as well in terms for declaration as for payment to the authorities and qualified organisms in your country. On that point, we advise you to consult the relevant local authorities. Whatever their origins are, all the orders are payable in euros.
J. BRACQ SAS reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the tariff in force at the time of the order validation and subject to stocks availability.
The products remain the property of J. BRACQ SAS company until full payment.
Warning : from the moment you take physically possession of the products ordered, the risk of loss or damage will be transferred to you.

The buyer, who wants to purchase a product on the “Atelier Dentelles” website must :
- Complete the identification form with all the contact information requested or provide a customer number if there is one
- Complete the online order
- Validate the order after verification
- Make the payment under the required conditions
- Confirm the order and its payment
All the data provided and the registered confirmation are used as evidence of the transaction. The confirmation acts as signature and acceptance of the transaction made.
We immediately confirm the orders received by email.
J. BRACQ SAS reserves the right to cancel any order of any customer with whom there is litigation relating to payment of a prior order.
In case of error in the addressee’s information provided by the buyer at the time an order is made, the seller shall not be held responsible for the impossibility of delivering the product.
Contractual information will be presented in French and will be subject to an order confirmation at the time of the order validation, at latest.
J. BRACQ SAS reserves the right not to register a payment, and not to confirm an order for whatever reason, and more particularly in case of supply problem or some other difficulty with regard to the order received.
The order validation
Confirmation of the order entails acceptance of the sales conditions herein, full acknowledgement of their content and renunciation of the buyer’s own purchasing or other conditions.
Summary information of the order and sales conditions herein, will be sent to you in PDF format to the purchaser’s email address.
Payment terms
The price of the products is payable cash the day when placing the final order. The order validation implies the customer’s obligation to pay the indicated price.
The order validated by the customer will only be considered final when the banking payment centers have approved the transaction. In case the centers refuse, the order will be automatically cancelled and the customer informed by email.
Payments by bank card will be made through the PayPal secure platform which uses SSL encrypts (Secure Socket Layer) so that information transmitted is encrypted by software and no third party can access this information during its transmittal on the network. At the request of the buyer, a paper invoice can be sent by mail showing the VAT.
Return Policy
Pursuant to article L121-16 of the French consumer’s Code, buyers, who are non-professional individuals, benefit from a time period of fourteen (14) working days after delivery of their order to return the product to the seller for an exchange or reimbursement without penalty, except for the return postage fees and customs duties.

If you are exercising the right of cancellation and return, JEAN BRACQ SAS will undertake the reimbursing of the amounts paid by the customer, in a maximum time period of 14 days (déjà dit plus haut) following your request and by the same way that the order payment was made. However The right to cancel shall not apply tor clearly personalized goods or "manufactured as per customer specifications".
Availability
Our products are on offer as they appear on the www.atelierdentelles.com website, in the limit of stock availability. In case of a product's unavailability after an order is made, the customer will be informed of the articles out by mail. The order will be automatically cancelled and no bank debit will be made.

After order confirmation, JEAN BRACQ SAS agrees to deliver all the referenced items ordered by the buyer to its shipper in a maximum time period of 7 business days.
In the event of late delivery, an email will inform the customer of a possible consequence on the delivery deadline he was indicated.
The items will be shipped to the address mentioned during the ordering process, within the delivery time stated on page “order validation“. If error during data input, JEAN BRACQ SASshould not be held responsible for the impossibility of delivering the product.
JEAN BRACQ SAS company cannot be held responsible for late delivery due to the dysfunctions of the carrier’s organization (Chronopost). Any possible delays do not give the buyer the right to claim damages.
In case of late delivery and in accordance with legal provisions, the customer has the possibility to cancel his order under the terms and conditions stipulated in article L.138-2 of the French consumer’s Code.
In the meantime, if you receive the product, we will proceed to its reimbursement and transport charges under the conditions of article L.138-2 of the French consumer’s Code.
All risks (loss, damage..) are at the Buyer’s charge at the time the goods leave the works/warehouse of Atelier Dentelles.In case of damage during the transport, the claim should be made on receipt with the shipper and in a time period of 3 days.
Guarantees
All our products benefit from the legal guarantee set forth in articles 1641 and the following of the French civil Code.
In case of noncompliance of the product sold, it can be returned to the seller who will take it back, exchange it or have the amount paid reimbursed.
All claims, requests for exchanges or reimbursements must be made by post at the following address :

Within a time period of thirty (30) days after delivery.
The “intact” product(s) must be returned to the seller for exchange or reimbursement, in its-(their) original packaging. (Déjà dit plus haut)
The shipping fees will be reimbursed to the customer on the basis of invoiced prices and the return costs will be reimbursed upon presentation of receipt.
In any case, JEAN BRACQ SAS’s liability is strictly limited to the value of the product blamed, value on its date of sale, without possibility of recourse towards the mark or the product’s manufacturer.
In accordance with Article 6, its provisions do not prevent the customer to benefit of the right of cancellation and return.
Liability
The products on offer comply with French applicable legislation. JEAN BRACQ SAS will not be held responsible for noncompliance with the legislation of the country where this one is delivered. However it is your responsibility to check with the local authorities the import or use possibilities of the products you intend to order.
Moreover, JEAN BRACQ SAS cannot be held responsible for damages of any kind that could result from the improper use and/or treatment contrary to the cleaning conditions of the marketed products.
Finally, JEAN BRACQ SAS would not be liable for any inconvenience and damage resulting from the use of the internet network such as loss of date, intrusion, virus, service disruption or other involuntary problems.
Litigation settlement
The online sales conditions herein are subject to French law. In case of litigation, jurisdiction is attributed to the competent courts of Douai, notwithstanding the number of defendants or recourse in warranty.
Intellectual Property
All the elements of the www.atelierdentelles website are the intellectual and exclusive property of JEAN BRACQ SAS company.
No one is authorized to reproduce, exploit, redistribute or use any element of the site, whether software, visual or sound displays even partially for any purpose whatsoever. Any simple or hypertext link is strictly forbidden with the express agreement of JEAN BRACQ SAS.
Personal Information
JEAN BRACQ SAS reserves the right to collect the buyer’s personal information pursuant to the French law of January 6th,1978 on data processing, data files and individual liberties. Therefore the buyer’s personal information can be subject to automated processing necessary for the order management and the improvement of the services and information we offer.
The personal information can also be transferred to the firms which contributes to such relationships, like those in charge of the orders and services processing necessary to their management, processing and payment.
These data and information are also stored for security precautions so as to comply with legal and statutory obligations.
Pursuant to the French law of January 6th,1978, the customer has a right to access, modify, rectify and delete information concerning himself, directly on website.
Records- Proof
JEAN BRACQ SAS will file the purchase orders and invoices on a reliable and lasting medium comprising a faithful copy pursuant to the provisions of article 1348 of the civil Code. The electronic records of JEAN BRACQ SAS shall be considered by the parties as proof of communications, orders and transactions that occurred between them.
